Limited Use Software License Agreement

This Limited Use Software License Agreement is a legal
agreement between you and APD S.A. By placing any of the
involved files in your computer, you are agreeing to be
bound by the terms of this Agreement. To become a registered
user you have to send payment to APD S.A. using the
enclosed registration form.
Conditions of use
- The files of APDMX Microkernel may not be modified
or adapted in any way. All the files on the original
package must be distributed together. In case of doubt,
contact APD S.A. for an original package.
- APDMX Microkernel may not be integrated into or
included as part of any other library or systems
software. It can only be used to build application
executables.
- Your right to distribute does not include the right to
sublicense or otherwise permit others to include
APDMX Microkernel in any other library or systems
software, or distribute it as part of any hardware or
software packages with the only exception contained in the
next paragraph.
- Registered users have the right to distribute an
unlimited number of copies of their applications built
using APDMX Microkernel, without paying nothing
apart a single registration fee. Any commercial release
of a commercial or shareware product built with
APDMX Microkernel must be notified to APD S.A.
- APDMX Microkernel-Shareware Version may not be
represented as anything other than shareware and the
shareware concept must be explained in any ad or catalog
and on any physical package. The explanation of the
shareware concept must make it clear that with shareware
an additional registration fee is required if users
continue to use the software.
- Non-commercial distribution of APDMX Microkernel-
Shareware Version needs no further permission as long as
it fulfils the terms of this licence. This includes any
distribution by a nonprofit organization, or by user or
computer interest groups to its members, or by any BBS,
anonymous FTP site , etc.
- You may not: modify, translate, disassemble, decompile,
reverse engineer, or create derivative works based upon
APDMX Microkernel.
- Copyright. APDMX Microkernel is owned by APD S.A.
and is protected by copyright laws and international
treaty provisions. You must treat Moonlight Microkernel
like any other copyrighted material, except that you
make copies of APDMX Microkernel-Shareware Version to
give to other persons under the terms of this Agreement.
- APD S.A. DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE
EXPRESSLY AND SPECIFICALLY DISCLAIMED. NEITHER APD S.A.
NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION,
PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE
FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES
ARISING OUT OF THE USE OR INABILITY TO USE SUCH
SOFTWARE, EVEN IF APD S.A. HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES OR CLAIMS. IN NO EVENT SHALL
APD S.A. LIABILITY FOR ANY DAMAGES EVER EXCEED THE PRICE
PAID FOR LICENSE TO USE THE SOFTWARE, REGARDLESS OF THE
FORM OF QUALITY AND PERFORMANCE OF THE SOFTWARE.
