INTRODUCTION
Congratulations on your selection of a HP high performance hard
drive. To receive the full benefit of your purchase, please use
this guide as a supplement to the installation instructions
delivered with your hard drive.
This guide provides detailed instructions to install the HP Hard
Drive into your PC/AT 286 (or higher processor) computer in the
following environments:
* DOS or DOS with Windows
* Windows `95
* Windows NT
* OS/2
Your hard drive may be configured to operate in any of the
following ways:
* To co-exist with an existing AT/E-IDE hard drive (See Option 1,
Dual AT/E-IDE Hard Drive Installation)
* To add a hard drive or replace an existing hard drive (See Option
2, Single AT/E-IDE Hard Drive Installation)
READ ME FIRST
PROTECT YOUR EXISTING DATA
HP recommends that you create a back-up copy of any important
files on your existing hard drive. You may save this information
on any alternative recording medium; for example, floppy disks or
to a tape drive. If you are replacing your existing hard drive,
this information may then be copied to your HP Hard Drive after it
has been installed in your computer. Refer to your computer
operating system manual for detailed instructions on how to back
up the files on your existing hard drive.
PROPER HANDLING OF YOUR HP HARD DRIVE
Before you unpack your HP Hard Drive please read the following
handling precautions and guidelines:
* Do not remove the hard drive from the anti-static bag until you
are ready to begin the installation process.
* Before beginning the installation process, make sure your
computer has been turned off and unplugged from its power source.
* Make sure that you are properly grounded before handling the
drive. For more information on grounding, see the section titled,
"Controlling Static Discharge", later in this section.
* Avoid touching the components on the hard drive circuit board.
* During handling, do not drop, jar, or bump the drive.
* Once you have removed the drive from the package, begin the
installation process immediately.
NOTE: This hard drive may contain preloaded
installation software. Please leave this
partition intact until you choose the
appropriate installation option.
TOOLS RECOMMENDED TO COMPLETE THE INSTALLATION
The following tools are recommended to complete the installation
of your HP Hard Drive:
* A small (#2) Phillips head screw driver
* Small needle nose pliers or tweezers (for removing/installing
jumpers)
* A bootable high density floppy diskette (1.44 MB) for your A:
drive
It may also be helpful to have your computer hardware manual and
operating system manual available for reference during the
installation. A system disk may also be required to complete the
installation of your new HP Hard Drive.
CONTROLLING STATIC DISCHARGE
Proper grounding is essential to prevent damage to the hard drive
and the computer. Discharge static electricity by touching the
metal chassis of your computer before handling the drive.
KIT COMPONENTS
If you purchased a HP Hard Drive Kit, the following accessory
components may have been included to assist you with the
installation:
1. 3.5 Inch Hard Drive
2. Front Panel
3. Hard Drive Mounting Adapters or Tray*
4. Mounting Screws
5. HP Disk Manager Installation Floppy Diskette
6. Hard Drive Installation Guide
*The C543X Hard Drive Kit includes a mounting tray instead of the
adapters, and does not include the front panel. This tray is used
for mounting the hard drive in an HP Vectra PC.
Familiarize yourself with each of these accessory components.
Depending on your particular computer setup, some or all of these
components may be needed to complete the installation of your HP
Hard Drive.
If you did not purchase a HP Hard Drive Kit that includes the
components mentioned above, it will be necessary for you to use
your existing components or purchase new components.
GETTING STARTED
You are now ready to install your HP Hard Drive. Please refer to
the instructions that follow to ensure a quick and easy
installation.
STEP 1
Turn off and unplug your computer.
STEP 2
Remove the computer's outside cover to gain access to the mother
board, interface cables, expansion slots and drive bays. This can
usually be accomplished by removing a few screws or releasing some
latches from the back of the computer.
STEP 3
Discharge static electricity by touching the metal chassis of your
computer before touching any of the internal components.
STEP 4
Take a moment to familiarize yourself with the inside of your
computer.
STEP 5
Record important information here about your HP Hard Drive for
future reference:

If you are going to install your new HP Hard Drive in your
computer together with an existing hard drive, please note the
model number and manufacturer name of that drive here for future

INSTALLATION OPTION 1
DUAL AT/E-IDE HARD DRIVE INSTALLATION
Reminder: If you have not completed the installation instructions
detailed in the section Getting Started, please return to this
section and complete the procedure detailed there before
proceeding with this installation option.
STEP 1: HARD DRIVE SETUP
If you are configuring your computer to include two hard drives,
one hard drive must be set up to function as the Primary (Master)
hard drive (C:), and the other set up to function as the Secondary
(Slave) hard drive. It is recommended that you designate your
existing hard drive to function as the Primary hard drive in your
computer and your HP Hard Drive as the Secondary hard drive.
If you designate your HP Hard Drive to function as the Secondary
hard drive, follow the instructions in the next section titled,
"Alternative A: Secondary Hard Drive Setup". If you are going to
designate your HP Hard Drive to function as the primary hard
drive, refer to the section titled, "Alternative B: Primary Hard
Drive Setup".
ALTERNATIVE A: SECONDARY HARD DRIVE SETUP
Your HP Hard Drive has been configured with the jumper option set
for the hard drive to be installed as the Primary (Master) hard
drive in your computer. To set up your HP Hard Drive to be the
Secondary (Slave) drive, you must change a jumper setting on the
hard drive circuit board. It may be necessary to adjust the jumper
setting on the Primary drive to recognize a Secondary drive in the
computer. Refer to the existing hard drive's operation manual to
ensure that it is properly configured.
(A jumper is a small piece of plastic that slides over pairs of
pins on the hard drive circuit board to make an electrical
connection and activate a specific option.)
To change the Primary/Secondary jumper setting on your HP Hard
Drive, locate the jumper on the hard drive circuit board labeled
J20. (Refer to the Microsoft Word file called "JMPRPIC.DOC" for
the jumper location diagram). Using needle nose pliers or
tweezers, remove the jumper from this location.
Note: The jumper across J23 and J24 is a spare. If the HP Hard
Drive is being installed in an HP Vectra PC, the Cable Select
option must be enabled on both drives. To enable Cable Select on
the HP Hard Drive, use needle nose pliers or tweezers to remove
the spare jumper and re-install it across J24. When Cable Select
is enabled, the Primary/Secondary Jumper (J20) is ignored.
Primary/Secondary assignment in this case is determined by where
the hard drive is plugged into the IDE cable. The Primary hard
drive will be the one plugged into the end connector of the IDE
cable.
Reminder: Avoid touching the components on the hard drive
circuit board. Always handle the drive by its sides only.
ALTERNATIVE B: PRIMARY (MASTER) HARD DRIVE SETUP
Your HP Hard Drive has been configured with the jumper options set
to be installed as the Primary (Master) hard drive in your
computer.
(A jumper is a small piece of plastic that slides over pairs of
pins on the hard drive circuit board to make an electrical
connection and activate a specific option.)
Note: The jumper across J23 and J24 is a spare. If the HP Hard
Drive is being installed in an HP Vectra PC, the Cable Select

the HP Hard Drive, use needle nose pliers or tweezers to remove

you must set up the existing hard drive to function as the

manual to ensure that it is configured properly.
It will also be necessary to change the CMOS configuration to
reflect the parameters of your existing hard drive as the
Secondary hard drive in the computer. Refer to your computer
hardware manual for instructions on how to change the CMOS
configuration.
STEP 2: COMPUTER SYSTEM PREPARATION
If you are replacing a hard drive currently installed in your
computer, remove the hard drive(s) to be replaced as follows:
1. Disconnect the ribbon cable from the hard drive interface
2. Disconnect the power cable connector from the hard drive
3. Remove the screws that secure the hard drive to the computer
4. Remove the hard drive from the computer
STEP 3: HARD DRIVE MOUNTING
Mount your HP Hard Drive into the space provided in your computer.
It may be possible to mount the hard drive directly into the space
provided or it may be necessary to attach the 5.25-inch Mounting
Adapters or Tray to the hard drive before installing it in your
computer. Use the Tray when mounting the HP Hard Drive in an HP
Vectra PC. If it is not apparent how the hard drive mounts into the
computer, refer to your computer hardware manual. Refer to the
Appendix for details on how to attach the 5.25-inch Mounting
Adapters or Tray to your HP Hard Drive.
Reminder: Avoid touching the components on the hard drive circuit
board. Always handle the drive by its sides only.
STEP 4: HARD DRIVE HOOK-UP
Connect pin 1 (red stripe) of the Hard Drive Interface Cable to
pin 1 of the hard drive connector on the mother board or adapter
board.
Connect pin 1 of either the middle connector or the connector on
the other end of the Hard Drive Interface Cable to the hard drive
connector of the previously installed hard drive.
Connect the remaining connector on the Hard Drive Interface Cable
to your HP Hard Drive. Pin 1 will be attached to the end of the
hard drive connector closest to the power connector.
STEP 5: POWER CABLE HOOK-UP
Locate any power connector cable coming from the power supply that
is not being used. Attach this cable to the power connector on the
hard drive. If there is not an extra power cable available in your
computer, it may be necessary to purchase a y-power cable (split
cable) to connect power to the hard drive.
STEP 6: COMPLETING THE HARD DRIVE INSTALLATION
NOTE: The HP Disk Manager Installation Utility
has been copied onto the hard drive at
the factory and also onto a floppy
diskette included in the Disk Drive Kit.
If you choose to use the HP Disk Manager
Installation Utility to configure the
hard drive in your computer, DO NOT
partition and format the hard drive
until the software has been copied onto
a floppy diskette as instructed below.
Before using your new HP Hard Drive, you must configure your
computer to communicate with the hard drive. You may complete this
step manually if your computer CMOS/BIOS is capable of logical
block addressing (LBA) or automatically with the HP Disk Manager
Installation Utility. Either method will ensure that you are able
to use all of the storage capacity of the hard drive.
CONFIGURING THE HARD DRIVE USING LOGICAL BLOCK ADDRESSING
If your system BIOS is capable of logical block addressing
(confirm LBA support by referencing your computer hardware
manual), you may manually configure your system by completing the
following steps:
a) Configure the CMOS/BIOS using LBA (refer to your computer
hardware manual for instructions).
b) Partition the hard drive by using the FDISK command on the DOS
system disk.
c) Format the drive partition(s) using the FORMAT command on the DOS
system disk.
CONFIGURING THE HARD DRIVE USING HP DISK MANAGER INSTALLATION
UTILITY
DOWNLOADING HP DISK MANAGER INSTALLATION UTILITY FROM THE HARD
DRIVE
If you do not have the HP Disk Manager Installation Utility on a
floppy diskette, perform the following steps. This will copy the
utility from the HP Hard Drive to a blank floppy diskette.
a) Update the computer CMOS/BIOS for the new hard drive using Type
9. Type 9 should equal 900 cylinders, 15 heads, and 17 sectors
per track. If Type 9 does not match these parameters on your
computer, select a user-definable drive type (UDT) and manually
input the parameters. If the computer does not have a UDT, select
a drive type that has 15 heads and 17 sectors per track.
b) Insert a bootable floppy diskette into drive A.
c) Boot to drive A.
d) Change from drive A: to the HP Hard Drive (i.e., C: or D:), type
ONTRACK and press Enter. The software will automatically be
copied from the hard drive to the floppy diskette. Once the copy
is complete, a working copy of the HP Disk Manager Installation
Utility will exist on the floppy diskette.
e) To configure the hard drive using this software, refer to step
"c" in the following sections.
INSTALLING HP DISK MANAGER INSTALLATION UTILITY FROM A FLOPPY
DISKETTE: DOS/WINDOWS BASED
To use the HP Disk Manager Installation Utility from a floppy
diskette, complete the following steps:
a) Insert a bootable floppy diskette into drive A: and turn on your
computer.
b) Remove the boot diskette and insert the HP Disk Manager
Installation Utility diskette.
c) At the A:> prompt, type DM and press Enter to start the
installation process.
d) Choose (E)asy Disk Installation from the HP Disk Manager
Installation Utility main menu and follow the screen's
instructions. Advanced users may choose (A)dvanced Disk
Installation from the HP Disk Manager Installation Utility main
menu to complete the installation manually and create custom
partitions.
NOTE: If you receive a message during the
installation that a previous partition
has been discovered, press ALT-C to
erase the HP Disk Manager Installation
Utility that was copied to the hard
drive at the factory. A single partition
will be created utilizing the full
capacity of the hard drive.
INSTALLING HP DISK MANAGER INSTALLATION UTILITY FROM A FLOPPY
DISKETTE: NON-DOS/WINDOWS BASED
To use the HP Disk Manager Installation Utility with an operating
system listed in the Introduction, complete the following steps:
a) Insert a bootable DOS floppy diskette into drive A: and turn on
your computer.
b) Remove the boot diskette and insert the HP Disk Manager
Installation Utility diskette.
c) At the A:> prompt, type DM and press Enter to start the
installation process.
d) Choose (V)iew/Print On-line Manual from the HP Disk Manager
Installation Utility main menu.
e) Choose Operating System Installation.
f) Select the appropriate installation option and follow the
screen's instructions.
Note: If you receive a message during the installation that a
previous partition has been discovered, press ALT-C to erase the
HP Disk Manager Installation Utility that was copied to the hard
drive at the factory. A single partition will be created utilizing
the full capacity of the hard drive.
NOTE: If the new HP Hard Drive is your primary
drive, you will need to install the
operating system on the new drive.
Before you begin the operating system
installation, boot the computer to the
hard drive. When you see the message
"Press space bar to boot from
diskette...," quickly press the space
bar and insert the first of your
operating system diskettes and proceed
with the installation.
Congratulations! You have completed the installation of your HP
3.5-inch AT/E-IDE Hard Drive.
INSTALLATION OPTION 2
SINGLE AT/E-IDE HARD DRIVE INSTALLATION
Reminder: If you have not completed the installation instructions
detailed in the section "Getting Started", please return to this
section and complete the procedure detailed there before
proceeding with this installation option.
STEP 1: COMPUTER SYSTEM PREPARATION
If you are replacing a hard drive currently installed in your
computer, remove the hard drive(s) to be replaced as follows:
1. Disconnect the ribbon cable from the hard drive interface
2. Disconnect the power cable from the hard drive.
3. Remove the screws that secure the hard drive to the computer.
4. Remove the hard drive from the computer
STEP 2: HARD DRIVE MOUNTING
Mount your HP Hard Drive into the space provided in your computer.
It may be possible to mount Adapters or Tray to the hard drive
before installing it in your computer. Use the Tray when mounting
the HP Hard Drive in an HP Vectra PC. If it is not apparent how
the hard drive mounts into the computer, refer to your computer
hardware manual. Refer to the Appendix for details on how to
attach the 5.25-inch Mounting Adapters or Tray to your HP Hard
Drive.
Reminder: Avoid touching the components on the hard drive
circuit board. Always handle the drive by its sides only.
STEP 3: HARD DRIVE HOOK-UP
Locate one end of the Hard Drive Interface Cable. Connect pin 1
(red stripe) of the Hard Drive Interface Cable to pin 1 of the
hard drive connector on the mother board or adapter board.
Connect the other end of the Hard Drive Interface Cable to your HP
Hard Drive. Pin 1 will be attached to the end of the hard drive
connector closest to the power connector.
STEP 4: POWER CABLE HOOK-UP
Locate any power connector cable coming from the power supply that
is not being used. Attach this cable to the power connector on the
hard drive. If there is not an extra power cable available in your
computer, it may be necessary to purchase a y-power cable (split
cable) to connect power to the hard drive.
STEP 5: COMPLETING THE HARD DRIVE INSTALLATION
Follow the instructions in Step 6 of Installation Option 1 in the
previous section to complete the hard drive installation.
Congratulations! You have completed the installation of your HP
3.5-inch AT/E-IDE Hard Drive.
FREQUENTLY ASKED QUESTIONS
WHY AM I NOT GETTING THE FULL CAPACITY OF MY NEW HARD DRIVE?
The maximum geometry that DOS and the BIOS (prior to translating
with LBA) can work with is 1024 cylinders, 16 heads, and 63
sectors. This works out to 528 megabytes. The HP Disk Manager
Installation Utility translates the number of cylinders and heads
so DOS can access the full capacity of your new drive. To access
your drive's full capacity, perform one of the following options:
* Install your hard drive using HP Disk Manager Installation
Utility.
* Use an enhanced IDE adapter board that supports LBA.
* Upgrade your computer BIOS to support LBA.
HOW DO I FIX THE "NO ROM BASIC" ERROR?
To correct this error:
* Set the primary partition "active" using the DOS FDISK utility
(option 2). This function will not affect your existing data.
HOW DO I FIX THE "INVALID DRIVE SPECIFICATION" ERROR?
To correct this error:
* Partition and format the hard drive.
HOW DO I FIX THE "NO FIXED DISK PRESENT", "HDD CONTROLLER FAILURE",
AND "DRIVE FAILURE" ERRORS?
To correct these errors:
1) Check the primary (master) and secondary (slave) jumper settings
on the hard drive(s).
2) Make sure power and interface cables are connected properly.
3) Check that the adapter board is properly seated in the mother
board.
4) Verify you have partitioned and formatted your hard drive(s).
5) Ensure the CMOS parameters are set properly for your hard
drive(s).
HOW DO I FIX THE "MISSING OPERATING SYSTEM" AND "NON SYSTEM DISK"
ERRORS?
To correct these errors:
1) Verify that you have copied the DOS system files to the primary
hard drive. (Using a DOS system diskette, type SYS.C at the A:>.)
2) Make sure you are booting to a bootable floppy/hard drive.
3) Ensure the CMOS parameters are set properly for your hard
drive(s) .
HOW DO I LOAD THE 32-BIT FILE AND DISK ACCESS FEATURE IN WINDOWS

To load the 32-bit file:
1) Choose (M)aintenance Menu from the HP Disk Manager Installation
Utility main menu.
2) Choose (I)nstall 32-DBA Driver. This will load a 32-bit driver in
Windows and update the system.ini file.
HOW DO I USE HP DISK MANAGER INSTALLATION UTILITY WITH AN OPERATING
SYSTEM OTHER THAN DOS/WINDOWS?
To use HP Disk Manager Installation Utility with an operating
system other than DOS/Windows:
1) Choose (V)iew/Print On-line Manual from the HP Disk Manager
Installation Utility main menu.
2) Choose Operating System Information.
3) Select the operating system installation procedure that you want
to install.
WHY CAN'T I ACCESS MY HARD DRIVE WHEN I BOOT FROM A FLOPPY DISKETTE?
The Dynamic Drive Overlay (DDO) must load before it can access the
hard drive.
To correct this problem:
1) Boot the system from the hard drive and press the space bar as
soon as the HP banner appears.
2) When prompted, insert the boot diskette in drive A: and press the
space bar. (You may also create a HP Disk Manager Installation
Utility boot diskette.)
3) Choose (M)aintenance Menu, from the HP Disk Manager Installation
Utility main menu.
4) Choose (C)reate Ontrack Boot Diskette.
HOW DO I FIX THE "DDO INTEGRITY ERROR" I GET WHEN I TRY TO BOOT?
This error occurs when there's a boot sector virus, when
applications are not closing properly and/or repair utilities are
not functioning properly.
To correct these problems:
1) Boot the system to a DOS diskette that you know is not virus
infected. (Use your DOS installation diskette if you do not have
a bootable DOS diskette that you know is virus-free.)
2) Run HP Disk Manager Installation Utility and from the main menu,
choose (M)aintenance Menu.
3) Choose (W)rite Boot Code in MBR.
4) Select Drive 1 (boot drive) to update the master boot record
(MBR).
5) Return to the previous menu option and choose (U)pdate Dynamic
Drive Overlay.
6) Verify the switches (if you did not previously modify them,
accept the defaults), and press enter to write the Dynamic Drive
Overlay.
APPENDIX
5.25-INCH MOUNTING ADAPTERS OR TRAY INSTALLATION
Mounting the HP Hard Drive into your computer will most likely be
accomplished by sliding the hard drive snugly into a slot,
referred to as a 3.5-inch wide drive bay, and securing the drive
with four Mounting Screws that are included in the package. If
your computer's hard drive bay is designed to accommodate a 5.25-
inch wide hard drive, you may need to attach the 5.25-inch
Mounting Adapters or Tray to the hard drive before mounting it in
the computer. When mounting the HP Hard Drive in an HP Vectra PC,
attach the Tray (not the Adapters) to the drive.
Once you have completed mounting the hard drive into your
computer, return to the installation option you chose previously,
and continue with the installation process.
NOTE: The hard drive may be mounted in the
computer with the hard drive circuit
board oriented in any direction (up,
down or on its side).
It is possible that your computer has unique mounting hardware
requirements. If the 5.25-inch Mounting Adapters or Tray does not
include all of the parts needed to install the hard drive in your
computer, contact your system vendor.

refer to the instructions on the hard drive label.

SOFTWARE LICENSE AGREEMENT
NOTICE TO CUSTOMER: THIS LEGAL AGREEMENT BETWEEN YOU AND ONTRACK
SPECIFIES THE TERMS UNDER WHICH ONTRACK GRANTS YOU A LICENSE TO
USE THE SOFTWARE, AND IS EFFECTIVE UPON YOUR RETAIL PURCHASE,
TELEPHONE ORDER/SHIPMENT/INVOICE, PURCHASE ORDER OR OTHER
CONFIRMATION OF SALE, OR USE. ANY CONTRARY POSSESSION OR USE IS
UNAUTHORIZED. IN SUCH CASE PROMPTLY RETURN THE SOFTWARE (AND ALL
WRITTEN MATERIALS AND CONTAINERS) TO THE PLACE WHERE YOU OBTAINED
THEM.
1. LICENSE GRANT. Ontrack Computer Systems, Inc. (Ontrack) grants
you (either as an individual or entity) a personal, non-
transferable, and non-exclusive right to use the Software on a
single computer. The "Software" is DISK MANAGER Hard Disk
Installation Utility for DOS (and included programs), the
Installation Guide/Instruction Manual, other documentation and
packaging, and is in "use" on a single computer when it has been
loaded into temporary memory (i.e., RAM) or installed into
permanent memory (e.g. hard disk, CD-ROM, or other storage
device) of that computer. Use of the another with the written
permission of ONTRACK, only under the following conditions: You
must transfer a copy of this License Agreement, all
documentation, and at least one complete, unaltered copy of the
software to the other party. You must, at the same time, either
transfer all your other copies of the Software to the transferee
or destroy them.
2. COPYRIGHT. The Software is copyright 1985-1995 by Ontrack
Computer Systems, Inc. and is protected by United States
copyright laws and international treaty provisions. All rights
reserved worldwide. You must treat the Software like any other
copyrighted material (e.g. a book or musical recording) except
that you may (a) make copies solely for backup or archival
purposes, and (b) transfer the Software to no more than a single
computer as described above. No part of the written materials may
be reproduced, transmitted, transcribed, stored in any retrieval
system, or translated into any language by any means without the
express written permission of Ontrack.
3. OTHER RESTRICTIONS. You may NOT: (a) transfer, rent, lease, or
sublicense the Software; (b) decompile, reverse assemble, or
reverse engineer the Software; (c) make any telecommunication
data transmission of the Software; or (d) permit use of the
Software in a: (i) computer service business; (ii) network; (iii)
timesharing; or (iv) multiple CPU or multiple user arrangement
unless all CPU's and/or users are properly individually or site
licensed by Ontrack.
4. TERMINATION. This License will terminate immediately without
notice from Ontrack if you fail to comply with any provision of
this License, including without limitation using the Software on
other than a single computer. Upon termination, you agree to
destroy the Software including all documentation and copies. This
is in addition to and not in lieu of any criminal, civil or other
remedies available to Ontrack.
5. NO WARRANTIES; NO LIABILITY FOR CONSEQUENTIAL DAMAGES; LIMITATION
OF LIABILITY; LIMITATION OF ACTIONS. THE SOFTWARE AND WRITTEN
MATERIALS ARE PROVIDED AND LICENSED "AS IS" WITHOUT WARRANTY OF
ANY KIND, AND THE ENTIRE RISK OF THE USE OF THE SOFTWARE AND YOU.
NEITHER ONTRACK NOR ITS SUPPLIERS MAKE ANY EXPRESS OR IMPLIED
WARRANTIES TO THE EXTENT PERMITTED BY LAW, AND SPECIFICALLY
DISCLAIM THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. IF SUCH DISCLAIMER IS NOT PERMITTED BY LAW,
THE DURATION OF ANY SUCH IMPLIED WARRANTIES IS LIMITED TO 90 DAYS
FROM THE DATE OF DELIVERY TO YOU. IN NO EVENT WILL ONTRACK OR ITS
SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY
CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY
KIND, OR LOST PROFITS, LOST SAVINGS OR OTHER ECONOMIC DAMAGES OF
ANY KIND, ARISING OUT OF THE USE OF THE SOFTWARE, EVEN IF ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT
ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION ON HOW
LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION
OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SUCH LIMITATION OR
EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY HAVE OTHER RIGHTS WHICH
VARY FROM JURISDICTION TO JURISDICTION. IN NO EVENT WILL THE
LIABILITY OF ONTRACK OR ITS SUPPLIERS FOR ANY CLAIM, WHETHER IN
CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE
RETAIL PRICE OF THE SOFTWARE IF ORDERED FROM ONTRACK. NEITHER
PARTY MAY BRING AN ACTION, REGARDLESS OF FORM, MORE THAN TWO
YEARS AFTER THE CAUSE OF ACTION AROSE.
6. MISCELLANEOUS. In the event of invalidity of any provision of
this agreement, the parties agree that such invalidity shall not
affect the validity of the remaining portions. You agree that you
will not export or re-export the Software without the appropriate
United States of foreign government licenses. The Agreement is
governed by the laws of the State of Minnesota as applied to
agreements between Minnesota residents entered into and to be
performed entirely within Minnesota. This is the entire agreement
between you and Ontrack which supersedes any prior agreement,
whether written or oral, relating to this subject matter.
U.S. GOVERNMENT RESTRICTED RIGHTS. Use, duplication or disclosure
by the Government is subject to restrictions as set forth in
subparagraph (c) (1) (ii) of The Rights in Technical Data and
Computer Software clause at DFARS 252,227-7013 or subparagraphs
(c) (1) and (2) of Commercial Computer Software-Restricted Rights
at 48 CFR.. 52.227-19, as applicable. Ontrack Computer Systems,
