By downloading or using VRML Express, you indicate your agreement to the terms of this license agreement. If you do not agree to the terms herein, you are not authorized to distribute, copy or use VRML Express and must destroy all copies obtained by you.
VRML Express is owned by ModelWorks Software and its suppliers and is protected by United States copyright laws and international treaty provisions. Except to the extent expressly licensed herein, all rights are reserved to ModelWorks Software and its suppliers. You may not reverse engineer, decompile, or disassemble VRML Express.
EVALUATION AND REGISTRATION. VRML Express is not free. You are hereby licensed to use this software for evaluation purposes without charge for a period of 15 days. If you use this software after the 15-day evaluation period a registration fee of $29 is required. See the Order form for details. When payment is received you will be sent an email containing a registration key which you will need to convert your shareware copy into a registered copy.
Unregistered use of VRML Express after the 15-day evaluation period is in violation of U.S. and international copyright laws.
One registered copy of VRML Express may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both. You may access the registered version of VRML Express through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network.
DISTRIBUTION. You may copy and distribute unregistered copies of VRML Express provided that this license agreement and all other files are included with the copy. You are prohibited from charging, or collecting a fee, for any such copies. You are also prohibited from distributing VRML Express with any other products without prior written (or email) permission.
RESTRICTED RIGHTS: Use, duplication or disclosure by the US government is subject to the restrictions as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer Software Clause as DFARS 252.227-7013 and FAR 52.227-19.
NO WARRANTIES. To the maximum extent permitted by applicable law, ModelWorks Software expressly disclaims any warranty for VRML Express. VRML Express and related files are provided AS IS without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. The entire risk arising out using VRML Express remains with you.
LIABILITY. ModelWorks Software's entire liability and your exclusive remedy, at ModelWorks Software's option, shall be the cost of VRML Express or its replacement with another copy of VRML Express. To the maximum extent permitted by applicable law, in no event shall ModelWorks Software or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this ModelWorks Software product, even if ModelWorks Software has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
GOVERNING LAW. This agreement shall be governed by the laws of the State
of Colorado.
