--------------------------------------------------------------------------- deltaComm Development, Inc., PO Box 1185, Cary, NC 27512 USA (919)-460-4556 voice, (919)-460-4531 FAX, (919)-481-9399 BBS Telix Copyright (C) 1986-1994 by deltaComm Development, Inc. --------------------------------------------------------------------------- Recently there has been somewhat of a controversy surrounding the status of copies of Telix purchased from various companies in the United Kingdom, and how to order Telix from other sites in Europe. This document shall be the final authority regarding the registration of copies from the European continent, notably in the United Kingdom. Exis, Inc. [hereinafter "Exis"], original developer of Telix from 1982 through late 1992, had contracted with ELSA GmbH of Aachen, Germany [hereinafter "ELSA"], as the exclusive registration site for Europe. ELSA and Exis then sold copies to a third registration site, Intershop, and later to another company in Glasgow, Speedmodem, Ltd., both with a contact person of George Collins [hereinafter "Intershop, et al"]. This arrangement was for the convenience of users in the United Kingdom, enabling them to pay in Sterling to a local site. Intershop, et al, was only to contact ELSA, a policy which was broken from time in order to expedite their demands. Exis sold all rights to Telix to deltaComm Development, Inc. [hereinafter "deltaComm"], on September 25, 1992. deltaComm and ELSA at that time renewed the agreement for ELSA to be the exclusive distributor for Telix in Europe (and recently renewed that agreement again in Germany, in January 1994). The relationship between ELSA and Intershop, et al., soured slightly before the change in copyright ownership for reasons which will not be discussed. At that time, ELSA and deltaComm agreed that it would be in the best interests of all involved to change registration sites in the United Kingdom. To that end, ELSA has appointed as the new registration site for Telix: S.C.S. Ltd. Hall Road, Martham Great Yarmouth Norfolk, ENGLAND NR29 4PD It has also come to our attention that companies that George Collins either controls or is associated with have continued to sell copies of Telix in Great Britain without first purchasing them from ELSA or deltaComm. Such copies may have had handwritten serial numbers on the disk labels that do not match the serial number formats of a Telix serial number. Some have been labeled "provisional serial number" diskettes. We regret to say that users who have purchased Telix in Great Britain who do not have a serial number that 1) matches the serial number format of Telix, and 2) cannot be accounted for as one of the several hundred that *were* sold to Intershop, et al., may not in fact be registered Telix users. ELSA no longer sells copies of Telix, directly or indirectly, to Intershop, et al., and has not since August, 1993. The directors of Intershop, et al., have also refused requests to turn over the complete database of the names and addresses of those who purchased Telix from those companies. This will regrettably make it extremely difficult for customers of Intershop, et al., to upgrade their copies via the new distributor, S.C.S., Ltd. We would like to try to reconstruct this database as accurately as possible in order to make these upgrades possible, since Intershop, et al., will not have access to official upgrades of Telix. We are therefore sponsoring a disk swap to insure that all Intershop/Speedmodem copies of Telix are removed from the market. All users who purchased their copy or copies of Telix from Speedmodem or Intershop should forward their name, address, original diskette and original receipt dated prior to November 1st to deltaComm at the address at the top of this document. We will replace each and every such copy with a legitimate copy, one with a valid serial number. We at deltaComm will insure that S.C.S. Ltd. is given each and every name and address we receive with a valid receipt and disk, and that S.C.S. passes on to us the names and addresses of all new registrees through them. The date mentioned is a date 30 days after the date which we estimate, based on ordering patterns, that Intershop, et al., would have certainly exhausted their supply of legitimate serial numbers purchased from ELSA. Any copies purchased after that date, we regret we cannot replace. All new copies of Telix in Great Britain should be purchased henceforth from S.C.S., Ltd., at the address listed above. S.C.S., Ltd. may from time to time sell to other dealers as they see fit. Any questions about the validity of a dealer selling copies of Telix in the UK should be directed to S.C.S., Ltd., at the above address. A convenient order form has been enclosed in the latest release of Telix to make this easier. It is called UK.REG. Please distribute this document as widely as possible within the United Kingdom, so that we can insure that all copies sold henceforth will be sold only through S.C.S., Ltd., the authorized registration site in the UK, or through dealers to whom S.C.S., Ltd., may sell. The current manner in which a European outside of the United Kingdom should register Telix is to do so via ELSA's appointed agents. Currently, only a site in Germany has been appointed in addition to S.C.S., Ltd., in the UK. Order forms for Europeans and their sites will be included with the latest copy of Telix. Version 3.22 includes EUROPE.REG and DEUTSCH.REG in addition to UK.REG mentioned above. Anything we can do to make your Telix experience more enjoyable we will do. Toward that purpose, ELSA will continue to seek local registration sites for other European countries for inclusion in later versions of Telix. Countries currently sought are The Netherlands, France, Spain, Finland, Sweden and Switzerland. Other countries may also be available. To inquire about the possibility of your company becoming an exclusive registration site for your country in Europe, send a company profile and cover letter to: ELSA GmbH Attn: Thomas Mertens Director of International Sales Sonnenweg 11 D-52070 Aachen GERMANY Sincerely, Zack Jones Director of Marketing deltaComm Development, Inc.
